Terms of Use of the cv-send Service
Public offer for the seafarer CV mailing service
The cv-send service (the “Service”) is owned and operated by a contractor registered in Ukraine and is designed for seafarers from any country in the world. By placing an order on cv-send.com, you (the “Customer”) enter into an agreement with the Contractor on the terms of these Terms of Use. If you do not agree to these Terms, please do not place an order.
1. The Contractor
- Contractor
- [ФОП / ТОВ — полное наименование исполнителя]
- Registration code
- [РНОКПП / ЄДРПОУ]
- Address
- [юридический адрес, Украина]
- account@cv-send.com
- Telegram
- https://t.me/cvsendcom
The Contractor operates in accordance with the legislation of Ukraine. The Service is provided remotely and is available to Customers regardless of their nationality or country of residence.
2. What the Service Includes
The Service consists of sending the Customer's CV by email to crewing companies and shipowners from the Contractor's database, within the scope of the selected package — by fleet type or worldwide. Each email is sent individually, on the Customer's behalf, with the subject line and message text the Customer specifies, and with the CV attached or linked.
- the selected package determines the list of recipient companies; the number of companies and addresses shown on the website at the time of ordering may change slightly as the database is updated;
- the Customer may exclude any companies from the mailing, including their current employer and Russian companies;
- the mailing is carried out in one or several waves on the date and at the time chosen by the Customer; repeat waves follow at the interval specified when ordering;
- once the mailing is complete, the Customer receives a notification, followed 24 hours later by a PDF report with anonymized delivery, open, and click statistics;
- replies from companies are sent directly to the email address specified in the order.
The Contractor is not a recruitment agency and does not act as an employment intermediary. The Service is deemed rendered once the emails have been sent to the recipients of the selected package.
3. What the Service Does Not Guarantee
- a response from any company, an interview invitation, or a signed contract;
- that a particular recipient will read the email: delivery depends on the recipients' mail servers, spam filters, and the companies' own actions;
- that vacancies at recipient companies are current at the time of the mailing.
Open and click statistics in the report are generated by technical means and are provided for reference only.
4. Ordering and Payment
- The order is placed on the website: the Customer selects a package, provides an email address, uploads a CV, and sets the message text and sending time.
- The price is shown on the website in US dollars at the time of ordering; payment can be made in US dollars, euros, or hryvnias at the payment provider's exchange rate, by card or cryptocurrency.
- A first-order discount is applied automatically when the conditions stated on the website are met.
- The agreement is deemed concluded, and the order accepted for fulfillment, once payment is received. The payment link is valid for a limited time; an unpaid order is cancelled.
- An electronic receipt and confirmation are sent to the email address provided.
5. Cancellation and Refunds
- Before the first mailing wave begins, the Customer may cancel the order by writing to the Contractor's email or Telegram; payment is refunded in full, by the same method it was made, less any payment-system fees that are not refunded by the provider.
- Once the mailing has begun, the Service is deemed rendered to the extent of the emails already sent; no refund is issued for a wave that has been sent, while unsent waves may be cancelled with a proportional refund.
- If the mailing was not carried out due to the Contractor's fault, payment is refunded in full within 10 banking days.
6. Customer's Obligations
- to provide accurate information and use their own CV, or the CV of a person who has given written consent to this;
- not to include in the CV or message text any unlawful content, malicious files, third-party personal data without a lawful basis, advertising, or material unrelated to job seeking;
- not to use the Service for mass advertising mailings or for any purpose unrelated to seeking employment at sea;
- to respond to companies and vet their offers independently; the Contractor does not review the terms of contracts offered by third parties.
If these conditions are breached, the Contractor may refuse to provide the Service without refunding payment for emails already sent.
7. Liability
The Contractor's liability is limited to the amount paid by the Customer for the specific order. The Contractor is not liable for the actions or decisions of recipient companies, the content of their replies, or losses arising from the unavailability of third-party email services, communication failures, or force majeure.
8. Intellectual Property
The CV and message text remain the Customer's property; the Customer grants the Contractor the right to use them solely to fulfill the order. The website's design, text, and software belong to the Contractor.
9. Personal Data
The processing of personal data is described in the Personal Data Processing Policy. By placing an order, the Customer confirms consent on the terms of that document.
10. Governing Law and Disputes
The relationship between the parties is governed by the legislation of Ukraine. Disputes are resolved through negotiation, and if no agreement is reached, in the court of the Contractor's place of registration, unless mandatory rules of the Customer's country provide otherwise.
The Contractor may amend these Terms; the new version is published on this page with an updated date and applies to orders placed after publication.
